Consistent with applicable legislation and Federal administrative policies, and based upon a determination that such action is necessary for the maintenance of public health and safety, protection of environmental or scenic values, protection of natural or cultural resources, aid to scientific research, implementation of management responsibilities, equitable allocation and use of facilities, or the avoidance of conflict among visitor use activities, the Superintendent makes the following changes to Missouri National Recreational River Regulations.1. Regulation change:
Effective Friday, August 16, 2024, from 2200 hours until 2300 hours CDT, the National Park Service (NPS) Missouri National Recreational River is implementing a temporary closure for all park users. Location of the closure is approximately river mile 805 west to river mile 805.5. Please refer to attached map. This closure will only affect the river itself in the designated area and will apply to all water activities; including but not limited to swimming, wading, fishing and all watercraft use.

3. Date of Adoption: August 7, 2024
4. Reasons for change: This closure is in response to a request from the City of Yankton, SD, Yankton, SD Search and Rescue and in compliance with National Fire Protection Association codes (NFPA). This decision was made after consultation with Yankton City Events Manager and Yankton Emergency Manager and is based on NFPA codes 1123 and 1126 which provide guidance regarding fallout zones and safety parameters for the firing of pyrotechnics (fireworks). The city of Yankton will be conducting a fireworks display during that time period as part of its annual Riverboat Days celebration. The fireworks will be fired from private property on the Nebraska shore but will likely detonate and display over the river. This temporary closure is to be implemented to provide for public health and safety during the fireworks event This closure will only affect the river itself in the designated area and will apply to persons on all watercraft.
The temporary closure will not adversely affect the park’s natural, aesthetic or cultural values; nor require significant modification to the resource management objections; nor, given the circumstances should it be of a highly controversial nature. Accordingly, the NPS determines publication as rulemaking in the Federal Register is unwarranted under 36 C.F.R. § 1.5(c). This is consistent with hundreds of earlier partial and temporary park closures or
public use limitations, the legal opinion of the Office of the Solicitor, and judicial adjudications. Pursuant to 36 C.F.R. § 1.7, notice of this public temporary closure will be made through media advisories, social media posts, maps, and by posting at conspicuous locations in the affected park.
