Introduction

These rules are applicable on the Delaware River from the confluence of the East and West Branches at Point Mountain in the vicinity of Hancock, New York to the #2 railroad trestle in the vicinity of Sparrowbush, New York, and on any lands owned or managed by the National Park Service (NPS) within the designated boundary of the Upper Delaware Scenic and Recreational River.

Lackawaxen Parking Lot (Delaware Aqueduct):

Grassy area to the south of the bluestone sidewalk leading to the front entrance of the Zane Grey Museum following along Lackawaxen Drive to the southeast corner of the NPS property (marked by concrete posts). Amendment to the Compendium - Skinner's Falls Bridge and River Closure

In accordance with regulations and the delegated authority provided in Title 36, Code of Federal Regulations (“36 CFR”), Chapter 1, Parts 1-7, authorized by Title 54 United States Code, the following provisions apply to all lands and waters administered by the National Park Service, within the boundaries of Upper Delaware Scenic and Recreational River. Unless otherwise stated, these regulatory provisions apply in addition to the requirements contained in 36 CFR, Chapter 1, Parts 1-7.

Purpose

The closure is intended to protect the public during construction and demolition of the Skinner’s Falls Bridge.

Management Priorities and Justification

Emergency removal of the historic Skinners Falls Bridge over the Delaware River in the interest of public safety. This decision comes after thorough bridge inspections revealed significant structural concerns that pose an imminent risk to the community and boaters using the Delaware River.

The bridge was closed to all traffic, including pedestrians, in October 2019 due to safety concerns.

Authority

The specific discretionary authority for National Park Service Superintendents to establish reasonable schedules for visiting hours, impose public use limits, and close park areas for all public use or specific use is found at Title 36 Code of Federal Regulations (CFR) §1.5 and other relevant provisions of Title 36.

Additionally: Upper Delaware and Scenic and Recreational River enabling legislation (95-625) and 36 CFR 1.2 and 5.7.

Effective immediately and pursuant 36 CFR 1.2 (a)(1-5), the Skinner’s Falls Bridge and river surrounding shall be closed to the public.

This order is effective immediately and will remain in effect until further notice. The effectiveness of this order will be assessed on an ongoing basis and will be modified or removed when conditions warrant.
