On private or state land, excavations or discoveries of Native American human remains are governed first by local or state laws, but human remains or cultural items removed from private or state land may be subject to the Native American Graves Protection and Repatriation Act (NAGPRA) as a holding or collection, depending on who has control of them.
Any institution or state or local government agency that receives Federal funds and has control of Native American human remains or other cultural items is subject to NAGPRA.
