What is a Film, Photography, and Sound Recording Permit?

A Film, Photography, and Sound Recording permit is an official authorization required for certain activities within national parks to ensure they align with the protection of park resources and do not interfere with public use and enjoyment.

At New Bedford Whaling National Historical Park, this permit is necessary for those engaging in filming, photography, or sound recording that could:

  • Impact Park resources by involving large equipment, staging areas, or potential disruptions.
  • Affect visitor experience by blocking pathways, creating noise, or restricting access.
  • Require oversight to ensure compliance with 36 CFR §5.5 and 43 CFR Part 5, Subpart A.

The permit process helps balance creative expression with the park’s mission to preserve history and provide a welcoming space for all visitors. It outlines specific guidelines, restrictions, and potential fees, depending on the scope of the project.

 

What Requires a Permit?

A permit is required for:

Who Needs a Film, Photography, or Sound Recording Permit?

Permits may be issued to:

  • Independent filmmakers and production companies
  • Professional photographers
  • News media organizations
  • Documentary and educational film crews
  • Other individuals or organizations conducting professional media work

A special use permit (SUP) is required for individuals, businesses, or organizations (including nonprofits and educational institutions) filming for a market audience or receiving compensation related to footage or recordings made in the park.

 

Permit Requirements

Filming

A permit is required for:

  • Advertisements, feature films, entertainment broadcasts, documentaries, promotional or educational films (including non-profit and student projects)
  • Filming for stock footage (regardless of equipment or crew size)

Still Photography

A permit is required for:

  • Still photography using models, props, sets, lighting, or other specialized equipment
  • Use of large or unusual equipment, even for non-commercial purposes if activities warrant oversight by park staff
  • Compensated portrait photographers hired to photograph weddings or other ceremonies/events, or portraits (weddings, family, senior, pets, engagement, etc) may require an SUP for Still Photography if group size exceeds 5 people using cameras and tripods only.

Sound Recording

A permit is required if the recording:

  • It takes place at location(s) where or when members of the public are generally not allowed
  • It uses equipment that requires mechanical transport
  • It uses equipment that requires an external power source other than a battery pack
  • The agency would incur additional administrative costs to provide management and oversight of the permitted activity to:
  • Avoid unacceptable impacts and impairment to resources or values
  • Minimize health or safety risks to the visiting public
 

Exemptions

A permit is not required for:

  • Visitors filming or taking pictures intended for their personal use and enjoyment DO NOT require permits.
  • For small-scale, low-impact filming, still photography and audio recordings, a permit may not be required. Please contact the park for details.
  • Credentialed news organizations documenting an event that cannot be covered at any other time or location. Please contact e-mail us for more information.
  • For clarification, please contact the park before planning your project.

 

Permit Application Process

  • Applications are available through the park’s administrative office or website.
  • Submit a completed application at least 10 days in advance.
  • Applications are reviewed for compliance with park policies and federal regulations.
  • The park accepts applications via email or USPS mail.
 

Permit Review & Approval

Permits may be denied if the proposed activity:

  • Causes damage to park resources.
  • Conflicts with park purposes or visitor access.
  • Poses safety concerns.
  • Requires exclusive use of public spaces.

Approved permits must be signed by the Superintendent and carried during the permitted activity.

 

Important Information

  • Fees & Cost Recovery: Location fees and cost recovery fees may be required.
  • Insurance & Security: Liability insurance and security deposits may be required.
  • Site Use: Permits do not guarantee exclusive use. Visitor access must be maintained.
  • Closures & Restrictions: Temporary closures due to weather, wildlife, or operational needs may impact permitted activities.
 

Unmanned Aircraft (Drones)

The launching, landing, or operation of uncrewed aircraft is prohibited in New Bedford Whaling National Historical Park except as approved in writing by the superintendent.

Interviews and Filming with Employees

Interviews with National Park Service employees may be available based on project content and staff availability. Any interview requests should be submitted via a permit application. If approved, cost recovery fees for staff time may be required. Please note that while staff may demonstrate aspects of their job, they will not "act" or spend time on multiple "takes". Filming of employees will be scheduled in advance and take place in a controlled environment.
