In accordance with regulations and the delegated authority provided in Title 36, Code of Federal Regulations (36 CFR), Chapter 1, Parts 1-7, authorized ty Title 16 United States Code, Section 3, the following provisions apply to all lands and waters administered by the National Park Service, within the boundaries of Jimmy Carter National Historical Park and Preservation District. Unless otherwise stated, these regulatory provisions apply in addition to the requirements contained in 36 CFR, Chapter 1, Parts 1-7.Written determinations, which explain the reasoning behind the Superintendent's use of discretionary authority as required by Section 1.5 (c), appear in this document identified by italicized print.

36 CFR SECTION 1.5 - VISITING HOURS, PUBLIC USE LIMITS, CLOSURES, AND AREAS DESIGNATIONS FOR SPECIFIC USE OR ACTIVITIES(1) The following visiting hours and public use limits are established for all or for the listed portions of the park, and the following closures are established for all or a portion of the park to all public use or to a certain use or activity:

Visiting Hours:

The Plains High School and Visitor Center will be open daily from 9:00 a.m. to 5:00 p.m. with the exceptions of three Federal holiday closures per year- Thanksgiving Day, Christmas Day and New Year's Day, and on Wednesday and Thursday each week during the winter season. The winter season has been defined to cover the months of January through March. This change goes into effect January 10, 2022.

The Jimmy Carter Boyhood Farm will be open daily from 10:00 a.m. to 5:00 p.m. with the exceptions of three Federal holiday closures per year - Thanksgiving Day, Christmas Day and New Year's Day.

The 1976 Campaign Headquarters and Plains Train Depot will be open daily from 9:00 a.m. to 4:30 p.m. with the exceptions of three Federal holiday closures per year-Thanksgiving Day, Christmas Day and New Year's Day.

Public Use Limits:

• Jimmy Carter National Historical Park is closed to all public access from sunset until 8:00 a.m. unless otherwise permitted in writing by the Superintendent.

• During emergency conditions, such as fire, ice and snow, park roads may be closed to the public without advance notice.

• Recreational activities such as picnicking and organized sports are allowed only in the picnic area and grass field located south of the Plains High School and Visitor center along County Road 45.

Closures:

Maintenance Area: The Maintenance Area location adjacent to Hospital Street is closed to public use.

Administrative Offices: All park Administrative office areas are closed to public use.

Carter Residence and Compound: The Carter Residence and Compound is closed to public use. See Appendix B for more information.

Boyhood Farm: The fenced in pasture located at the Boyhood Farm is closed to public use. See Appendix C for more information.

Unmanned Aircraft: Launching, landing, or operating an unmanned aircraft from or on lands arid waters administered by the National Park Service within the boundaries of Jimmy Carter National Historical Park is prohibited except as approved in writing by the Superintendent.Definition: The term "unmanned aircraft" means a device that is used or intended to be used for flight in the air without the possibility of direct human intervention from within or on the device, and the associated operational elements and components that are required for the pilot or system operator in command to operate or control the device (such as cameras, sensor, communication links). This term includes all types of devices that meet this definition (e.g. Model airplanes, quad-copters, drones) that are used for any purpose, including for recreation or commerce.

Determination: Due to security concerns related to access to the Carter Residence and Compound via unmanned aircraft, the park implements this ban. This compendium closure is also a necessary interim measure until the NPS considers how to address this new use on a long-term basis. Allowing the use of unmanned aircraft before the park has properly evaluated whether this use is appropriate could result in unacceptable impacts to park resources, park values and visitor safety.

(a)(2) The following areas have been designated for a specific use of activity, under the conditions and/or restrictions as noted:

• The Picnic Area, located south of the Plains High School and Visitor Center adjacent to the front parking lot, is designated for visitor picnicking. Picnic tables shall be used on a "first-come first-served basis". The picnic area is only open during park hours.

• The Baseball Field, located south of the Plains High School and Visitor Center, is available for non-organized recreational activities and for organized use such as a baseball, softball, or soccer field. It shall be used on a " first-come first-served basis" for non-organized recreational use. Use of the Baseball Field for organized recreational use requires a Special Use Permit. See Appendix A for more information.

• Passenger-carrying buses must shut down their engines when parked in any of the park's parking lots.

Determination: The idling of bus engines adds unnecessary exhaust fumes to the air and diminishes the enjoyment by park visitors and park neighbors of the park's peace and tranquility. Due to the nature of the service provided by shuttle buses, these vehicles are excluded from this requirement.

• The park's First Amendment Area, located at the entrance to the Plains High School and Visitor Center along County Road 45, is designated for public assemblies, gatherings, meetings, demonstrations and other public expressions of views.

Determination: For the purposes of maintaining the values for which the Historical Park was established by its authorizing legislation, it hereby designates only this specific area for the purpose of First Amendment Rights. Under a Special Use Permit, the request will be reviewed and deemed as appropriate and reasonably consistent with protection and use of the park areas for the purposes for which it was established.

Public Health and Safety:

When the COVID-19 Community Level is LOW or MEDIUM in the county or all the counties where the park is located based on data provided by the Centers for Disease Control and Prevention (CDC), individuals are not required to wear masks.

When the COVID-19 Community Level is HIGH in the county or all the counties where the park is located based on data provided by the CDC, all individuals over the age of two must wear masks, regardless of vaccination status, in all common areas and shared workspaces in buildings owned, leased, or otherwise controlled by the National Park Service, including, but not limited to, park visitor centers, administrative offices, lodges, gift shops and restaurants.

Masks must cover the nose and mouth and fit snugly around the nose and chin with no large gaps around the sides of the face. Masks not designed to be protective, masks with ventilation valves, and face shields do not meet the requirement.


36 CFR SECTION 1.6- ACTIVITIES THAT REQUIRE A PERMIT

Activities requiring a permit are listed above under Public Use Limits and throughout this document under the specific 36 CPR Section that authorizes or requires the issuance of a permit. Application for permits may be obtained from the Superintendent's office and shall be submitted for approval at least two weeks prior to the scheduled date of the event.

36 CFR SECTION 2.1- PRESERVATION OF NATURAL, CULTURAL AND ARCHEOLOGICAL RESOURCES

(a)(4) Using or possessing wood gathered from within the park area is prohibited.
(a)(S) Walking, climbing, entering, ascending, descending or traversing an archeological or cultural resources, monuments or statue is prohibited.
(b)(5) Hiking or pedestrian traffic is restricted to the trail or walkway as listed in Section 1.5 of this document.

Under Section 2. l(a), collecting natural materials from the park is generally prohibited. However, pursuant to Section 2.1 (c), the following fruits, nuts, and berries may be gathered by hand for personal use or consumption, in accordance with the noted size, quantity, collection sites and/or possession and consumption restrictions:

• Blackberries
• Mulberries
• Persimmons
• Pecan Nuts - visitors are allowed to harvest up to one grocery bag/day for personal use
• Walnuts
• Pine Cones
• Acorns
• Chestnuts

36 CFR SECTION 2.4 - WEAPONS. TRAPS. AND NETS

(a)(2)(i) Weapons, traps, or nets may only be carried, possessed or used at the following designated times and locations:

• When accessing the park roads as a throughway to reach other destinations
• When in compliance with Georgia State Law for carry or concealment of a firearm

NOTE: Despite Georgia Law, possession of weapons, traps or nets are prohibited inside of Federal facilities.

36 CFR SECTION 2.5 - RESEARCH SPECIMENS

Taking plants, fish, wildlife, rocks or minerals is prohibited except in accordance with other regulations Chapter 1 of 36 CFR or pursuant to the terms and conditions of a specimen collection permit.

36 CFR SECTION 2.10 - CAMPING AND FOOD STORAGE

Camping is not allowed in the Jimmy Carter National Historical Park.

36 CFR SECTION 2.11 - PICNICKING

Picnicking is allowed in the picnic area south of the Plains High School and Visitor Center along County Road 45 (see Appendix A) and beside the parking area at the Boyhood Home.

Conditions for Picnicking:

• Picnic table top use of a camp stove or hibachi style grill is prohibited.
• Open fires and stand-alone grills are prohibited.

36 CFR SECTION 2.12 - AUDIO DISTURBANCES

(a)(2) Operating a power saw in developed areas is prohibited, except pursuant to the terms and conditions of a permit.

(a)(3) Operating any type of portable motor or engine, or device powered by a portable motor or engine in non-developed is prohibited, except pursuant to the terms and conditions of a permit.

(a)(4) Operating a public address system is prohibited, except in connection with a public gathering or special event for which a permit has been issued pursuant to Section 2.50 or Section 2.51.

36 CFR SECTION 2.15 - PETS

(a)(l) The following structures and/or areas are closed to the possession of pets.

• With the exception of guide or service animals, pets are not allowed in any buildings or structures within the Park. Pets must be on a leash not exceeding 6 feet and under physical control of their handler at all times while at Jimmy Carter NHP.

(a)(S) Pet excrement must be disposed of in accordance with the following conditions:

• Pet excrement must be collected and disposed of in a trash receptacle.

36 CFR SECTION 2.21 - SMOKING

All park buildings, structures and facilities are closed to smoking, including any shed, barn, building or out-building.

Determination: Smoking is prohibited in all government buildings and vehicles to comply with government-wide health and safety policies. Smoking is prohibited where posted and during high fire danger in order to protect park resources and reduce the risk of fire.

36 CER SECTION 2.2 - WILDLIFE PROTECTION

The transporting of lawfully taken wildlife through the park is permitted under the following conditions and procedures:Wildlife taken outside of Federal property in accordance with Georgia State Hunting Regulations may be transported through the park of U.S. Highway 280, County Road 45 and Old Plains Highway, provided that, in exception of emergency situations the transporting vehicle does not stop or deviate from its route through the park.

36 CFR SECTION 2.22 - PROPERTY

(a)(2) Leaving property unattended for longer than 24 hours is prohibited.

• Property, particularly vehicles, left within the park after closing hours and after a National Park Service official has reasonably attempted to locate the owner, will be determined to be unattended.
• Following this determination, a vehicle will be towed at the owner's expense and the owner will be held responsible for reclaiming their property.
• If prior arrangements are made, temporary and emergency repairs must be completed within twenty-four (24) hours.
• Other property will be recorded under lost and found procedures and disposed in accordance with title 41 CFR.
• Park employees are allowed to leave vehicles in the park while they are in a travel status for official government travel.

36 CFR SECTION 2.35 - ALCOHOLIC BEVERAGES AND CONTROLLED SUBSTANCES

(a)(l) The use and possession of alcoholic beverages within park areas is allowed in accordance with the provisions of this section:

• Alcoholic beverages may be consumed ONLY within the established picnic area in accordance with applicable age requirements under state law or in areas/buildings deemed appropriate for a special occasion as designated under a special use permit.

36 CFR SECTION 2.37 - NON-COMMERCIAL SOLICITING

Soliciting or demanding gifts, money, goods or services is prohibited except pursuant to the terms and conditions a permit that has been issues under Section 2.50, Section 2.51 or Section 2.52.

36 CFR SECTION 2.38 - EXPLOSIVES

(a) Using, possessing, storing or transporting explosives, blasting agents or explosive materials is prohibited, except pursuant to the terms and conditions of a permit.(b) Using of possessing fireworks and firecrackers is prohibited, except pursuant to the terms and conditions of a permit.

36 CFR SECTION 2.50 - SPECIAL EVENTS

(a) Sport events, pageants, regattas, public spectator attractions, entertainments, ceremonies, and similar events are allowed provided there is a meaningful association between the park area and the events and the observance contributes to visitor understanding of the significance of the park area, and a permit therefore has been issued by the Superintendent.

36 CFR SECTION 2.52 - SALE OR DISTRIBUTION OF PRINTED MATTER

Sale or distribution of printed matter by 25 persons or fewer may be conducted without a pemit in designated park areas, provided that the requirements in Sections 2.52 are met.

(a)The sale or distribution of printed matter by more than 25 persons is allowed within park areas designated as available under Section 2.51 9f), when the Superintendent has issued a permit.

36 CFR 2.62- MEMORIALIZATION

(a) The installation of a monument, memorial, tablet, structure, or other commemorative installation in a park area without the authorization of the Director is prohibited.

(b) The scattering of human ashes from cremation is prohibited, except pursuant to the terms and conditions of a permit.

36 CFR SECTION 2.62 - BICYCLES

(a) The use of bicycles including electric bicycles are permitted on roads associated with the Plains High School and Visitor Center, the Plains Depot, the Boyhood Farm and in parking areas within the park, but is not permitted at the Carter Residence and Compound.

36 CFR SECTION 4.21-SPEED LIMITS

(a)The following speed limits are established for the routes/roads indicated:

• County Road 45 - thirty-five (35) mph
• Old Plains Highway - thirty (30) mph
• Entrance Road to the Boyhood Farm - twenty-five (25) mph

36 CFR SECTION 5.1 -ADVERTISEMENTS

Commercial notices or advertisements shall not be displayed, posted, or distributed on federally owned or controlled lands within a par area unless prior written permission has been given by the Superintendent.

36 CFR SECTION 5.3 - BUSINESS OPERATIONS

Engaging in or soliciting any business in park areas, except in accordance with the provisions of a pem1it, contract, or other written agreement with the United States, except as such may be specifically authorized under special regulations applicable to a park area, is prohibited.

36 CFR SECTION 5.5 - COMMERCIAL PHOTOGRAPHY

The following types of filming activities may occur in areas open to the public without a permit and without advance notice to the NPS:

*Outdoor filming activities [outside of areas managed as wilderness] involving five persons or less and equipment that will be carried at all times, except for small tripods used to hold cameras.

The organizer of any other type of filming activity must provide written notice to the Superintendent at least 10 days prior to the start of the proposed activity. Based upon the information provided, the superintendent may require the organizer to apply for and obtain if necessary to:

*Maintain Public health and safety
*Protect environmental or scenic values
*Protect natural or cultural resources
*Allow for equitable allocation and use of facilities; or
*Avoid conflict among visitor use or activities.

If the Superintendent determines that the terms and conditions of a permit could not mitigate the concerns identified above in an acceptable manner, the Superintendent may deny a filming request issuing a permit. The superintendent will provide the basis for denial in writing upon request.

The NPS will consider requests and process permit applications in a timely manner. Processing time will vary depending on the complexity of the proposed activity. If the organizer provides the required 10 days advance notice to the NPS and has not received a written response from the NPS that a permit is required prior to the first day of production. The proposed filming activities may occur without a permit.

The following is prohibited:

(1) Engaging in a filming activity without providing advance notice to the superintendent when required.

(2) Engaging in a filming activity without a permit if the activity takes place in areas managed as wilderness or if the superintendent has notified the organizer in writing that a permit is required.

(3) Violating a term and condition of a permit issued under this action.

Violating a term or condition of a permit issued under to this action may also result in the suspension and revocation of the permit by the Superintendent.

36 CFR SECTION 5. - CONSTRUCTION OF BUILDINGS OR OTHER FACILITIES

Such activities are prohibited, except in accordance with the provisions of a valid permit, contract, or other written agreement with the United States.
