RFP for Equestrian Facility

This Request for Proposals (RFP) provides the opportunity for any interested individual or organization (Offeror) to submit a proposal to the NPS to lease the equestrian facility at Bergen Beach, Brooklyn, NY under the following terms and conditions. The selected Offeror will have exclusive rights to negotiate a lease with NPS based on the attached Sample Lease (Exhibit D).In the event the NPS and a selected Offeror fail to execute a lease, or in the event any such lease is terminated resulting in a vacancy, the NPS reserves the right to negotiate a lease with the next highest ranked Offeror. Until a Lease is executed, the NPS reserves the right to reject one or all proposals, discontinue the solicitation, or terminate negotiations without penalty or liability.

Key Dates for this Request for Proposals: Proposals must be submitted on or before August 1, 2025 by 1 pm EDT. The RFP solicitation will be open for a minimum of 60 days. Questions about this opportunity must be submitted by July 25, 2025 at 1:00 PM EDT.

Proposal Submission Protocol

Proposals must be submitted electronically to GATE_BMD@nps.gov. Telephonic proposals, faxes, e-mails to other addresses, and other means of transmittal will not be considered. Proposals that are not received at the designated electronic address by the specified deadline will not be considered. NPS will not consider hardcopy proposals. Proposals are not deemed received until confirmed in writing by NPS.

Site Tour and Additional Information

Site tours will be available on June 9, June 16, and July 7 at 11:00 AM. Reservations required.Tour reservations and questions about this RFP may be sent via email to GATE_BMD@nps.gov. Questions from interested parties will be answered via Question & Answers (Q&A) or Frequently Asked Questions (FAQs) and will be posted, as will the RFP and attachments, at: https://www.nps.gov/gate/getinvolved/leasing-program-at-gateway.htm. Questions must be submitted by July 25, 2025, at 1 pm EDT.

PROPOSAL REQUIREMENTS

Proposals must be submitted electronically to: GATE_BMD@nps.gov. Proposals must be submitted on or before the time and date provided on the first page of this Request for Proposals. The subject line should include the following: Bergen Beach Equestrian Proposal - [Your name or the name of your business entity or organization].Proposals are limited to 25 pages or fewer, not including attachments. Proposals exceeding this limit will be deemed non-responsive and will not be evaluated further.Offerors should submit their proposal in electronic format as one document in the Adobe PDF format. The required Identification and Credit Information forms (either 10-352, 10-353, or 10-354), the required Financial Information for Revenue-Producing Uses Forms (10-355 and 10-355A), financial statements, and credit reports should be incorporated into your PDF submission as attachments. Proposals must be formatted to 8-1/2" x 11”-page size. Proposals submitted by mail, in-person delivery, telephone, fax, or other methods will not be considered.While there is no limit on the file size of your proposal (please note the 25-page limit described herein, excluding attachments), the total file size of the email submission, including all attachments, cannot exceed 40MB. If your proposal exceeds this limit, you must separate your document into smaller files and send them in separate emails. If you do this, please separate your proposal into as few files as possible and clearly name the files so they can be reassembled in your intended order.Effective proposals should be organized in the order of the Required Information detailed in the Request for Proposals and should contain clear, concise responses that address all the questions and requirements for each of the Selection Criterion listed in the RFP. Frequently Asked Questions

Q1: Are there any outstanding financial obligations from NPS to the current operator which must be satisfied prior to a transfer of structures and infrastructure (including buildings, energy systems, communications networks, water and sanitation systems, etc.), to a new lessee?
A1: NPS has no financial obligations to the current operator. All Improvements to the premises are property of the United States and will be part of the “as-is” condition for a new lease. Portions of the utility systems are outside the premises and do not belong to the United States.

Q2: Will all current fencing, and exterior finishes remain?
A2: Yes. Fencing is an Improvement. Fencing and other exterior improvements on the premises will be part of the “as-is” condition for a new lease.

Q3: Do the existing finishes inside the barn and stalls transfer to a new lessee? Examples: footing, automatic water feeders, stall hardware, installed stall mats, stall gates, and stable, arena, and outdoor light fixtures.
A3: All improvements made to the premises are the property of the United States; however, Personal Property (i.e., furniture, fixtures, and equipment neither permanently attached to, nor forming a part of, the Premises) and trade fixtures remain the property of the current lessee.

Q4: When was the electric service installed? When were the last upgrades?
A4: The premises were constructed April 1973 with electric service approximately the same period. No recent upgrades.

Q5: Will the transformer on the property transfer to a new lessee?
A5: Yes. The installed transformer is an improvement to the premises and will be part of the “as-is” condition for a new lease.

Q6: Do the existing mechanicals (HVAC, boiler, gas, kitchen mechanicals, etc.) transfer to a new lessee?
A6: Yes. The existing mechanical, electrical, and plumbing systems are improvements to the premises and will be part of the “as-is” condition for a new lease; however, trade fixtures are personal property of the current lessee.

Q7: Is there any paperwork pertaining to the installation of the electrical service, such as blueprints and permits?
A7: Portions of the utility service lines are outside the premises and do not belong to the United States. Available drawings will be provided to the successful offeror.

Q8: Is there a deeded right-of-way for the section of the electrical service located on the north side of the Belt Parkway that services this property? 
A8: Unknown. NPS does not have documents related to non-federal land.

Q9: Is the water/sewer provided by NYC and is there a blueprint for these services available?
A9: Water is provided by the City of New York; wastewater treatment is by septic system. Available drawings will be provided to the successful offeror.

Q10: How many septic tanks are on the property and is there a blueprint for the septic tank(s) that can be shared? What is the size of each septic tank? When was the septic tank installed/last replaced?
A10: There are three septic tanks, each approximately 20 feet in diameter. Concrete septic rings were installed in 2014. There are no drawings for the septic system.

Q11: Is there a Certificate of Completion / underwriters inspection paperwork for improvements on the property that can be shared?
A11: None found.

Q12: When was the last Sprinkler Flow Test/Annual Fire Safety Test conducted and did it pass?
A12: Fire sprinkler system passed inspection by City of New York Fire Department on 3/12/2020.

Q13 Is a CUA permitted to be applied for within the land assignment for a food concession?
A13: Food service may be allowed under the lease terms with prior written approval from NPS (there is no CUA). See Sample Lease, Section 6.

Q14: Can communications towers be installed in the land assignment of this lease? |
A14: No, not on the leased premises; however, NPS does occasionally consider requests for communications towers. An application for a tower on adjacent federal land outside of the premises is a possibility.

Q15: Will the NPS deliver the premises free of all personal property including: horses, trailers, tack, merchandise, etc. if transferred to a new licensee?
A16: Absent an alternative agreement, the premises will be delivered free of all personal property.

Q16: Does the existing intellectual property (name, domain name, website, branding, trademarks) for this facility transfer to a new lessee?
A16: No. Intellectual property belonging to the current lessee would not transfer to a new lessee unless an agreement is reached between the parties.

Q17: How many boarders are currently at this facility (not owned by licensee)?
A17: As of the third week of June 2025, there were approximately thirty boarding horses.

Q18: Will operating revenue and expense figures be provided?
A18: No.

Q19: Will the Fair Market Value Rent (FMVR) be based on percent of gross receipts only or a base rent plus a percent of gross receipts, or a fixed rent without a precent percentage of gross receipts?
A19: FMVR will be determined by an appraisal of the “as-is” condition of the Premises. The mix of base rent and precent rent (if any) will reflect local market conditions.
