Response to Questions on RFP to Lease Diablo East Marina Solicitation #L-AMIS001-19

1) Are the electrical pedestals along the marina docks set up to be metered for the individual boats in the slips?

NPS Response: Yes.

2) The RFP states that all of the Trex Rub Rails needed to be replaced. Looking at the inside of the boat slips, the grey-painted boards looked just fine for about 80-90% of the slips so why would they would need to be replaced?

NPS Response: The grey-painted boards that look just fine are just boards. Trex Rub Rails are missing. Trex Rub Rails are made of a rubber-type material that protect a boat from hitting up against the dock (the grey painted boards) and damaging the boat.

3) How old is the 2,000 gallon gasoline storage tank at Diablo East?

NPS Response: Approximately 10 years old.

4) Would a lessee need two work barges, one for Diablo East, and one for Rough Canyon?

NPS Response: No, if there is a common lessee for both marinas, it could use one barge to service both.

5) Is it possible to rent houseboats under the lease?

NPS Response: Yes. See Section 6.1 of the Sample Lease. Houseboat rentals are authorized.

6) Is it possible to rent jet skis at the marina?

NPS Response: Yes. See Section 6.1 of the Sample Lease. Small boat (jet ski) rentals are authorized.

7) Is the lessee required to sell gas to boaters at the gas dock?

NPS Response: No. This service is authorized.

8) Can the lessee construct a small section of dock boat slips and place in the cove behind the marina store?

NPS Response: The Lessee may not increase the number of docks, slips, side tie spots, or buoys at the commencement of the Lease. Increases may be allowed by the Lessee later in the Lease term after the Park Area determines capacity limits of the lake and Park Area infrastructure. Rent would be reconsidered accordingly.

9) How difficult is it to move all of the slips into the protected cove behind the marina store?

NPS Response: At this time, lake levels are too low to move the slips into this cove. If lake levels change in the future, the Lessee can seek approval from the NPS to relocate the docks.

10) Does the lessee have to replace the roof over the patio on the front and side of the marina store?

NPS Response: Yes. This is part of the improvement project “Replace Flat Porch Roof all around Store.” See Section 3(C) of the RFP and Exhibit D to the Sample Lease.

1) Will the Big Dock be brought to working order before we take over?

NPS Response: No. The Lessee agrees to lease the Premises in their existing “as is” condition. The base rent takes the condition of the facilities into consideration.

2) Will the Pump out dock be brought to working order before we take over with the exception of the 3 listed items under the Improvements section?

NPS Response: No. The Lessee agrees to lease the Premises in their existing “as is” condition. The base rent takes the condition of the facilities into consideration.

3) Will new concrete block anchors be set for the mooring lines before taking over?

NPS Response: No. The Lessee agrees to lease the Premises in their existing “as is” condition. The base rent takes the condition of the facilities into consideration.

4) Will new cables be attached to the new anchors?

NPS Response: No. The Lessee agrees to lease the Premises in their existing “as is” condition. The base rent takes the condition of the facilities into consideration.

5) Will mooring buoys be set as well?

NPS Response: No. The Lessee agrees to lease the Premises in their existing “as is” condition. The base rent takes the condition of the facilities into consideration.

6) If the answer is NO to any of the items needing to be addressed: How many concrete block anchors are available for use?

NPS Response: None.

• Are the concrete blocks still sitting at the Park Service ramp?

NPS Response: No.

• Will the blocks be hauled to Rough Canyon?

NPS Response: No.

• Is there any cable already purchased for use?

NPS Response: No.

• Are there any shackles, cable clamps or thimbles?

NPS Response: No.

7) Can lessee request more mooring lines so we can take the burden off of the big dock and just use it for smaller boat rental?

NPS Response: The Lessee may not increase the number of docks, slips, side tie spots, or buoys at the commencement of the Lease. Increases may be allowed by the Lessee later in the Lease term after the Park Area determines capacity limits of the lake and Park Area infrastructure. Rent would be reconsidered accordingly.

8) 10.1. Lessee’s responsibilities: (g) paying to the proper authority, when and as the same become due payable, all taxes and assessments imposed by federal, state, or local agencies applicable to the Premises or the Lessee’s activities on the Premises -What does this mean? How much taxes and assessments could be imposed?

NPS Response: State and local laws, including taxing authority, sometimes apply within NPS units. However, the NPS does not provide tax or other legal advice to lessees related to these matters. Under the terms of the Lease, a Lessee is responsible for complying with all “Applicable Laws,” and is likewise responsible for determining which laws may apply, including laws with respect to taxes or assessments.

9) If there is no Lessee for the Diablo East Marina, will those approximately 15 displaced boats have to be accommodated at the Rough Canyon Marina.

NPS Response: No.

10) Can we make our own contract with the boat owners in the marina?

NPS Response: Yes, it is expected that the Lessee will issue all new rental agreements. However, the rental agreement must be approved by the NPS. While the NPS is hopeful the new Lessee will give preference to renting to current slip holders, this is not required and the Lessee can initiate an open solicitation.

11) Will the boats, not current on the dock or mooring fees, be removed from the marina before the new lease begins?

NPS Response: It is preferable that the Lessee try to establish new rental agreements with all current slip holders. Any current slip holders who do not elect to sign a new agreement with the Lessee will need to remove their boats at the boat owner’s expense.

12) Prior to taking over the lease will the Lessee be responsible for removing boats from the lake if fees are not paid?

NPS Response: Any current slip holders who do not elect to sign a new agreement with the Lessee will need to remove their boats at the boat owner’s expense. Any boats that are not removed, after the proper notification, will be considered voluntarily abandoned or unclaimed, and the NPS will remove these boats according to 36 C.F.R 2.22, and Title 41 C.F.R.

13) Will the new lessee have to try and collect back rent from the boat owners?

NPS Response: No.

14) Is it required to own a barge prior to selection? If not, will that affect the decision to be selected as the lessee?

NPS Response: No, you do not have to own a barge, but you have to be able to demonstrate that you have the necessary funds to purchase/lease a barge or you have guaranteed access to a barge.

15) Is it required to secure insurance prior to selection?

NPS Response: No. You just have to demonstrate that you can acquire the required insurance.

16) Is it a problem to create a new LLC for this business opportunity?

NPS Response: It is not a problem to create a new LLC for this opportunity. However, be sure to explain how this entity will be supported financially and operationally until it is self-sufficient. Also please see instructions related to credit reports.

17) It can only be assumed that the requirements for improvements were only 3 items because everything else that is majorly wrong with the Rough Canyon Marina will be fixed prior to the lease being handed over?

NPS Response: No. The Lessee agrees to lease the Premises in their existing “as is” condition. However, under Criterion 6 in Section D of the RFP, “Offerors may also propose, in sufficient detail, other Alterations, as that term is defined in the Sample lease, to the Premises for the NPS to consider.”

18) Is there power to the electrical pedestals on the Rough Canyon marina dock?

NPS Response: Yes, but it is only 120 volt, not enough for connecting to houseboats, generators, etc.

19) Does the NPS have statistics on how many boaters use the lake daily, broken down by summer use and winter use.

NPS Response: No. The NPS does not have statistics broken down by different user groups, including boaters. Visitation statistics showing monthly overall visitation, including breakdowns of different Park Area locations are available online at. https://irma.nps.gov/Stats/Reports/Park/AMIS
