Protocol
for filling public requests for planning documents
All
current planning documents are available without charge upon request,
with the following exceptions:
- For public comment responses up to 100 pages, separate individual
responses are available without charge.
- Complete public comment sets that contain over 100 responses are available
for a copying fee.
- In addition, public hearing documents are available without charge
as soon as the documents are delivered to planning staff from a court
reporter.
- Historic planning documents are available to the public, however a
copying fee may be charged.

Policy
for Filling Non-FOIA Requests for Planning Documents
We frequently get requests for a variety of planning related
documents from members of the public. The following protocol is intended
to clarify and expedite our ability to provide copies of those documents
in a timely manner.
We commonly receive requests for current planning documents.
Documents are defined as current until:
- Sixty days past
the close of the pubic comment period
- Thirty days after
a Finding of No Significant Impact (FONSI)
- Sixty days after
release of Final Environmental Statement (FEIS) or Record of Decision
(ROD), the later of whichever time is applicable.
These documents include
Draft Environmental Assessments (EAs), Draft Environmental Impact Statements
(EISs), draft plans, public comment responses, and public hearing transcripts.
We also frequently receive requests for post-draft decision documents, such
as FONSIs and modified FONSIs, FEISs, and RODs. To submit a non-FOIA request
for a copy of a current planning document, send a written request to the
Yosemite National Park Office of Strategic Planning.
We also commonly receive requests for historic planning documents.
Documents are defined as historic 60 days past the close of the public comment
period, 30 days past a FONSI, or 60 days after the release of a FEIS or
ROD. These historic documents made available to the public include draft
EAs, EISs and FONSIs, modified FONSIs, FEISs, and RODs. Any supporting documents
to primary planning documents, for example books, articles, papers, reports,
studies that are cited in the bibliography of a primary planning document,
by definition are ‘historic’ public documents. However, non-published
data and draft studies and reports, unless cited in a planning document,
are not public documents. To submit a non-FOIA request for a
copy of a historic planning document, send a written request to the Yosemite
National Park Research Librarian.
FOIA Information
The Freedom of Information Act (FOIA) of 1966 requires federal
agencies to make administrative documents and reports available to the public
for inspection and copying. All information in those documents is available
to the public, unless:
- It is protected
by one of the nine exceptions to FOIA,
or if
- Disclosure is prohibited
by law or Executive Order, or if
- Disclosure could
result in harm to an individual, commercial entity, or the government.

non-FOIA request.
