DEVELOPMENT PLAN

 

A. Purpose

The purpose of the Development Plan is to describe the process for selection of professional consultants needed to design and develop construction documents for the facilities and exhibits; and the roles and responsibilities of NPS and the Foundation with respect to the programming, design and construction of the facilities, programming, design and construction of the exhibits and interpretive venues, restoration of the Cyclorama painting, and the removal the existing visitor centers, their parking lots and entry roads and the rehabilitation of the historic appearance of Ziegler’s Grove.

B. Selection of Professional Consultants

1. The Foundation will engage an interdisciplinary design team(s) for the project. The NPS will retain the right to review and approve the individual consultant firms and /or individuals included within the design team(s). Any major changes that may occur to the composition of the team(s) during the progress of the work will be made with the concurrence of NPS. Review and approval of the individual consultant firms and/or individuals included on the design team(s) and concurrence with changes to the team by NPS will be reasonable and timely. The Foundation and NPS intend to collaborate throughout the design process to develop the project.

2. The Foundation will determine, and NPS will provide input and guidance to, the scope of services for the design team and its associated products. NPS will review and approve the scope of services for the design team. All review by NPS will be reasonable and timely.

C. Programming and Design of the Project

1. The NPS will provide information relevant to the proposed program of the project, including applicable federal, state and local regulations, published NPS standards generally applicable to similar facilities, all relevant documents, including plans, planning studies and documents, and other mutually agreed criteria. Applicable published NPS standards include: NPS-6, Interpretation and Visitor Services; NPS-28, Cultural Resource Management; NPS-40, Dams and Appurtenant Works; DO 42, Accessibility for Visitors with Disabilities in NPS Programs, Facilities and Services; DO 50-B, Occupational Safety and Health; DO 77-1, Wetlands Protection; DO 83, Public Health; Principles of Sustainable Design; and various instructions and memoranda regarding the review of the project by the NPS’ Development Advisory Board.

The Foundation and the design team will review the program and recommend changes that may be needed to increase sustainability, consider life cycle costing, and provide for value analysis of the project. NPS will review and approve the recommended changes to the program. All review by NPS will be reasonable and timely. After NPS review and approval of changes, the Foundation will prepare a final program for the project.

2. The Foundation will prepare schematic design documents, including value analysis, for the project, in accordance with the approved program. A process will be developed that will keep NPS continually informed of the progress of the work. The NPS will review the schematic design documents at 35%, 75% and 95% completion. NPS will review and approve the final schematic design documents. The Foundation and the design team understand that review of the schematic design documents by the NPS’ Development Advisory Board is required prior to NPS approval of the schematic design documents. The Development Advisory Board meets on a regularly scheduled basis, and it reviews project scope, alternatives considered, value analysis of the project, project schedule, cost per square foot, and other related information. The Foundation and the design team will assist NPS in the presentation of the project to the Development Advisory Board, and will make changes necessary to meet their requirements.

3. The Foundation will prepare design development and construction and bidding documents for the project. The NPS shall review the design development and construction and bidding documents at 35%, 75% and 95% completion.

D. Design and Fabrication of Exhibits, including interpretive venues

  1. NPS will provide interpretive themes and objectives to the Foundation, as the basis for preparation of all interpretive exhibits within the museum, exhibits required as a part of the information and orientation function, and interpretive fee programs, such as the Cyclorama program, the orientation program, and the theater.
  2. The Foundation will establish an Interpretive Advisory Group, the members of which will be selected by the Foundation and approved by NPS. The purpose of the Interpretive Advisory Group will be to provide advice on the interpretive themes and objectives, and upon the content of interpretive exhibits and programs. NPS will attend meetings of the Interpretive Advisory Group.
  3. The NPS will provide access to the Gettysburg NMP artifact and archival collections for the exhibit design team selected by the Foundation (with the approval of the NPS) for the purpose of identifying the extent and range of the collections, and of selecting appropriate items for conservation, curation, and display in the museum, the resource center, or other interpretive exhibits and programs within the project. The NPS will have the right to approve all items recommended for display.
  4. The plans and specifications for exhibit fabrication and installation shall include the costs, as necessary, for curation of materials selected for exhibition.
  5. NPS will review and approve the script for any still or motion picture, film, or similar theatrical production. The Foundation will work with NPS to obtain permits for filming on park property, if these are needed.

E. Restoration of the Cyclorama Painting

  1. The Foundation will assemble a conservation team to undertake the project in consultation with NPS. The NPS will retain the right to review and approve the individual consultant firms and /or individuals included within the design team(s). Any major changes that may occur to the composition of the team(s) during the progress of the work will be made with the concurrence of NPS. NPS will provide technical assistance and technical oversight for the conservation project, at the request of the Foundation.
  2. NPS will provide access to the Gettysburg cyclorama for the conservation team selected by the Foundation for the purpose of identifying and documenting the conservation needs of the painting, and for its necessary treatment. NPS will provide to the Foundation information relevant to the restoration of the painting, including applicable federal, state and local regulations, published NPS standards generally applicable to similar work, and all relevant documents, including plans, planning studies and documents. Applicable documents include the Gettysburg National Military Park Collections Management Plan and Director’s Order 28, Cultural Resource Management.
  3. The oversight and direction of the consultants and conservators who undertake the research and treatment of the Cyclorama painting shall be the joint responsibility of the Foundation and the NPS. NPS review and approval of all phases of research and treatment of the Cyclorama painting as set forth above shall relieve the Foundation from all liability for the condition of the Cyclorama painting before, during or after its restoration. The Foundation shall have no obligation to insure the Cyclorama painting.
  4. Phase I of the work is research. The research must include a careful review of the literature regarding cyclorama treatment theory and approaches and must evaluate both new and traditional materials. Complete documentation of the cyclorama, including both photographic documentation and an understanding of the treatment history of the Gettysburg cyclorama will be needed. Comparative studies of other cycloramas, their condition, treatment histories and installations, and of the other Gettysburg cycloramas would help determine the best treatment and installation options for the Cyclorama painting in the new facilities. Understanding through investigation and thorough study of the methods of support and suspension of the painting will be required. The result of the research will be a cost estimate and a schedule for treatment. NPS will review and approve the research, and its approval will be reasonable and timely.
  5. The Foundation will undertake the treatment of the Cyclorama painting in accordance with the agreed upon cost estimate and schedule for treatment. NPS will review and approve the detailed treatment proposals for treatment and re-installation of the cyclorama. It is planned to undertake the treatment of the painting within the existing Cyclorama Center. If possible, the Foundation and the park will provide opportunities to the public to observe the conservation process.
  6. The Foundation will incorporate the recommendations for optimum mounting of the painting, conservation of the painting, and building design to accommodate installation of the painting in its project design. Among other matters, the space in the new cyclorama painting gallery must provide sufficient access to the back of the painting for its appropriate annual maintenance.
  7. Once the new gallery is prepared, the Foundation will install the painting in the new gallery.

F. Construction of the Project

  1. The Foundation will enter into contract(s) for site development for the new facilities, construction of new facilities, artifact/archival curation of items selected for exhibit, exhibit fabrication and installation, relocation of all NPS furnishings and equipment from the existing visitor center and Cyclorama building into the new facility, demolition of the existing visitor center and Cyclorama building and their entry roads and parking lots. The rebuilding of the original portion of Hancock Avenue between the current Cyclorama parking lot and Taneytown Road, and rehabilitation of the historic landscapes currently occupied by this development will also be undertaken by the Foundation, based upon designs provided by the NPS. The NPS will have the right to review and approve all such contracts.
  2. The Foundation will be responsible for obtaining any necessary licenses and permits, and for complying with any federal, state and municipal laws, codes and regulations applicable to the performance of the work needed to accomplish the project.
  3. The NPS and the Foundation will coordinate all aspects of demolition and construction activities that may have an impact upon park visitors or park programs, to avoid and minimize such impacts. The NPS’ and the Foundation’s contractor(s) or subcontractor(s) shall hold periodic meetings to coordinate the construction with the operation of the park. NPS understands that demolition of the park’s existing visitor centers would take place after its relocation to the new facilities at a time to be mutually agreed upon. NPS will provide such special use permits as are necessary for construction on federally-owned lands within the park boundary. NPS’ issuance of such permits will be reasonable and timely. NPS will provide the design, all environmental clearances and other investigations or studies and all permits necessary for the Foundation to accomplish the required demolition of the park’s existing visitor centers and rehabilitation of those areas.
  4. NPS will provide necessary and agreed upon temporary and permanent access to NPS lands for the purpose of construction access and staging. NPS will provide rights-of-way as necessary and agreed upon for extension of utilities and roads from current public rights-of-way across NPS owned lands onto Foundation property.
  5. The Foundation will provide day-to-day project administration and supervision, and will be responsible for dealing with all matters related to the construction contracts. NPS will monitor these activities on a regular basis. The Foundation will be responsible for maintaining all necessary records relating to construction, project expenditures, shop drawings and sample approvals, addenda, change orders, modifications, daily logs and reports. The Foundation will provide "as constructed" drawings complying with accepted industry practice to NPS. The Foundation will be responsible for maintaining detailed operations and maintenance manuals for all major systems and equipment, and will provide a copy of all such manuals to Gettysburg National Military Park. NPS shall be included in the distribution and review of project submittals and records in a manner that is mutually acceptable to NPS and the Foundation.
  6. If, in the reasonable opinion of NPS, any discrepancies occur between the approved Foundation design and the actual work performed, NPS will notify the Foundation’s representative in writing, setting forth in detail the exact nature of the discrepancy (ies). Upon receipt of such written notice from NPS, the Foundation will promptly cease work related to the discrepancy (ies) until a mutually satisfactory solution can be determined, within a period not to exceed three business days.
  7. The Foundation and NPS will jointly participate in pre-final and final inspections of any completed work. The Foundation will not accept any work as being complete or acceptable without first receiving written approval from NPS, which shall not be unreasonably withheld. The Foundation will provide copies to NPS of all major contract records executed for the project, as well as any other contract records agreed upon mutually by the Foundation and NPS.
  8. The Foundation, its contractor(s) and subcontractor(s) shall follow manufacturer’s recommendations and instructions regarding warranty requirements for major systems and equipment, as well as any other systems and equipment identified by mutual agreement, and submit the proper documentation and forms necessary.

G. Amendments to the Development Plan

The NPS and the Foundation mutually understand and acknowledge preparation of the comprehensive design for the project may cause either or both parties to recommend changes to this Development Plan. Such revisions may be recommended by either party to the other. Modifications, revisions, or additions to this plan shall be made in writing and will become effective only upon the written approval of both parties to the plan. Amendments must be dated and signed by the Key Official or other authorized representative to this agreement.
