Compendium of Designation, Closures, Request
Requirements and Other Restrictions imposed
under the discretionary authority of the
Superintendent

In accordance with regulations and the delegated authority provided in Title 36, Code of Federal Regulations, Chapter 1 through 7, authorized by Title 16, United States Code, Section 3, management, protection, government and public use of Booker T. Washington National Monument.

Unless otherwise stated, these regulatory provisions apply in addition to the requirement contained in 36 CFR, Chapter 1.

Section 1.5 Closures and public use limits

(a) (1) Kite flying is prohibited year round during and after visiting hours.

(a) (2) The area immediately adjacent to the picnic area between the woodline and the Burroughs' cemetery is designated as the park´s first amendment assembly area.

Section 1.6 Permits

(a) The Superintendent issues permits authorizing the use of park resources for scientific and recreational purposes.

Section 2.1 Preservation of natural, cultural, and archeological resources

(c) (1) Reasonable gathering of the following may be gathered for personal use or consumption:

All edible fruits
All edible berries
All edible nuts, except American Chestnuts
All edible mushrooms

Section 2.2 Wildlife protection

(d) Transporting wildlife through the boundaries of Booker T. Washington National Monument is prohibited except when escorted by a Park Ranger.

(e) Use of artificial light to view wildlife between the hours of sunset and sunrise is prohibited except when such activity is necessary for management purposes.

Section 2.3 Fishing

Fishing in the park is done in conjunction with Virginia State regulations. Fishing in the park is permitted during park operational hours, 9:00 a.m. to 5:00 p.m.

Section 2.4 Weapons, traps and nets

All weapons are prohibited in the park.

Section 2.5 Research specimens

(a) The taking of plants, fish, and wildlife, rocks, or minerals are prohibited without a Specimen Collection Permit issued by park Superintendent.

Section 2.10 Camping

(a) Camping is prohibited in the park year round, unless authorized by the Superintendent or his/her designate.

Section 2.13 Fires

Fires are permitted in the picnic area. All fires will be restricted to grills or other suitable receptacles.

Section 2.15 Pets

(a) Pets are prohibited in the park visitor center and buildings in the historic area, except animals used by the visually impaired.

(d) Animals not claimed within a reasonable period of time after the owner has been notified or those whose owner cannot be identified, will be turned over to the local dog warden.

(e) Pet excrement shall be removed from the picnic area, exhibit area and other areas of heavy public use.

Section 2.21 Smoking

Smoking is prohibited in all buildings in the historic area, the visitor center, and the headquarters buildings.

Section 2.22 Property

(2) Property may not be left unattended for longer than 24 hours unless authorized by the Superintendent or his/her designate.

Section 2.35 Alcoholic beverages and controlled substances

(a) (3) The possession of a bottle, can or other receptacle containing an alcoholic beverage that is open, or whose seal has been broken or the contents of which have been partially removed are prohibited.

Section 2.50 Special events

(a) Special events such as public spectator attractions and ceremonies will be allowed under a special use permit issued by the park Superintendent or his/her designated representative so long as the event contributes to visitor understanding and significance of the park and does not:

(a) (1) cause injury or damage to park resources
(a) (2) impair the atmosphere of peace and tranquility or is contrary to the purposes the park or area of the park were established
(a) (3) unreasonably interfere with park operations
(a) (5) present a danger to public health and safety
(a) (6) conflict with other existing uses

Section 2.51 Public assemblies, meetings

(a) Public assemblies, meetings, gatherings, demonstrations, parades and other public expressions of views are allowed by special use permit in the designated assembly area (reference Section 1.5 (a)(2)) unless the event may:

(e) (1) cause injury or damage to park resources
(e) (2) impair the atmosphere of peace and tranquility or is contrary to the purposes the park or area of the park were established
(e) (3) unreasonably interfere with park operations
(e) (5) present a danger to public health and safety

Section 3.21 Swimming and bathing

All park waters are closed to swimming and bathing.

Section 4.30 Bicycles

(a) The use of a bicycle is prohibited except on paved park roads, in parking areas and on routes designated for bicycle use. Bicycles are prohibited in the historic area and on park trails.

Section 5.1 Advertisements

Commercial notices or advertisements shall not be displayed, posted, or distributed within the park.

Section 5.3 Business operations

Engaging in or soliciting any business in park areas, except in accordance with the provisions of a permit, contract, or other written agreement with the United States, is prohibited.

Section 5.5 Commercial photography

Before any motion picture is filmed or still photography is taken for commercial purposes, written permission must be obtained from the park Superintendent.
